SYNOPSIS |

The Planning Commission reviewed the proposed POD request at its December 2, 2004 meeting. There were registered objectors present. All property owners within 200 feet of the site, all residents within 300 feet, who could be identified, the Johnson Ranch Neighborhood Association and the Westchester/Heatherbrae Neighborhood Association were notified of the Public Hearing. |

BACKGROUND |
The applicant submitted a request to rezone the site from R-2, Single-family to PCD to allow the development of two lots abutting Cantrell Road (Lots 1 and 2) as commercial and the development of the remaining lot (Lot3) as an office development. The applicant indicated |

BACKGROUND CONTINUED |
Lot 3 would contain four office buildings totaling 40,000 square feet. The applicant indicated the building setback at 36-feet from the southern property line.
The applicant amended his request to allow the placement of a 13,600 square foot office building on proposed Lot 2 and the placement of four buildings totaling 40,000 square feet of office on proposed Lot 3. The applicant requested to be allowed no accessory or conditional uses on proposed Lots 2 and 3 but the allowance of concentration of the ten percent commercial activities, typically allowed for O-3, General Office District zoned properties, on proposed Lot 1. The applicant indicated the proposed building would not exceed 5,300 square feet.
Prior to the December 2, 2004 Public Hearing the applicant again revised his request, to include the development of the proposed three lots with only O-3, General Office District uses and the allowable ten percent accessory uses located in each of the individual buildings. The applicant also increased the rear yard buffer area to 48-feet. The buffer included 36-feet of undisturbed landscape and the addition of plantings within the buffer area to enhance the existing landscape.
At the December 2, 2004 Public Hearing the applicant agreed to increase the rear yard buffer area to 58-feet. The applicant indicated there would be a 36-foot undisturbed buffer, a fifteen foot retaining wall to be constructed of architectural block, a ten foot bench to be landscaped and a second wall with a maximum height of nine feet. The applicant indicated a six foot wood fence would be placed at the top of the second retaining wall to screen the adjoining properties. The Highway 10 Design Overlay District typically requires a rear yard landscape buffer of 40-feet.
The site is shown as Transition on the City’s Future Land Use Plan. The applicant previously filed a request for a land use plan amendment to change the site from Transition to Commercial and later amended his request to change from Transition to Mixed Use for Lots 1 and 2. This request was withdrawn after the applicant amended his request to allow the development of the site as only an office development.
